Xania Terms and conditions

This is an agreement between you and Goelway.com LLC (with its affiliates, “Goelway”, "GOEL", "we" or "us"). To ensure best experience, ensure to read these Goelway self-publishing Terms of Use, the Goelway.com Privacy Notice (on website), the Goelway.com Conditions of Use (on website), and the other applicable rules, policies, and terms posted on the Goelway.com website or provided with any Service (collectively, this "Agreement") before purchasing or using any aspect of this service. By using the Xania, purchasing or using any content therein, or using any aspect of the Service, you agree to be bound by the terms of this Agreement on behalf of yourself and all members of your household and others who use the Service under your account. If you do not accept the terms of this Agreement, then you may not use the Xania, or any content therein.
1. Xania content
Use of Xania's content: Use of Xania’s content: The content provider grants you a non-exclusive right to view, use, and display such content upon your download or access of Xania’s content and payment of any applicable fees (including applicable taxes), only through GOEL software or as otherwise permitted as part of the Service, and only for your individual, non-commercial use. The content provider does not sell you Xania’s content; rather, it licenses it to you. The provider of the content may include extra terms for use in its content. These terms shall also apply, but in the event of a conflict, these Terms shall control.
Limitations: Unless otherwise specified, you are not permitted to remove, alter, sublicense, sell, rent, lease, distribute, broadcast, or sublicense any proprietary notices or labels on the Content. Additionally, you are not allowed to make any attempts to get around any DRM system or other content protection measures that are implemented as part of the service.
Book returns: You may return a book you purchase from the Xania as permitted in our return policy.
2. Use of Xania software
You may be able to distribute content to others or yourself using the software's import, upload, export, share, and other distribution features ("distribute"). Any content that promotes hatred, violence, or terrorism as well as adult content, child sexual abuse, or other abusive materials may not be imported, uploaded, exported, shared, submitted, or distributed in any other way. You may only share content with someone if they have given you permission; sharing content without their permission is prohibited. You are only permitted to share content for personal, non-commercial use; you are not permitted to make any kind of direct or indirect profit from sharing content on any platform. Every piece of content you share is entirely your responsibility. GOEL disclaims all liability and responsibility for any content distributed by you or any third party. GOEL retains the right to investigate any suspected violation or other misuse of any Service, and may review and remove any content and associated metadata.
3. General
The Xania software will collect and provide information to GOEL about how you use it, including information on how it interacts with the service and the content therein (such as your last page read; content that you use, distribute, or archive; your viewing data and search queries; and available memory, up-time, log files, and signal strength). Servers outside of the nation in which you currently reside may hold your personal information. The Goelway.com privacy notice will be followed in handling any information we obtain.
Data Disclosed to Others: For any information you give to users of the Service, you are solely responsible. Any privacy notice or other terms that they may provide to you will apply to how these third parties may use the information you provide to them.
Termination due to fraud: If you break any of the terms of this agreement, your rights under it will automatically end. Additionally, we reserve the right to revoke your license to use the software immediately if we determine that it has been used fraudulently or otherwise inappropriately, or if you have violated any of the terms of this agreement. In such a case, you must stop using the software altogether, and GOEL may immediately revoke your access to it without paying any fees again. If GOEL does not insist on or enforce your strict adherence to this agreement, it will not be deemed to have waived any of its rights.
Amendments and service changes: We reserve the right to add or remove content from any software at any time without prior notice, as well as to change, suspend, or discontinue the software entirely. By publishing the revised terms on the goelway.com website, we reserve the right to change any of the terms of this agreement at any time. After the revised agreement terms take effect, if you use any GOEL software or a service in any way, you are deemed to have accepted the terms
Limitation of Liability: (1) Under no circumstances shall our or our software licensors' aggregate liability to you for any and all damages resulting from your use of, or inability to use, any Xania software exceed fifty dollars (KSh 1,500); and (2) Under no circumstances shall our or any other content provider's aggregate liability to you for any and all damages resulting from your use of any service exceed one hundred twenty-five dollars (US$100) (excluding Xania software). These limitations nevertheless hold true even if the solutions are ultimately unsuccessful.
